Please read these terms carefully before using the Peak Marketing website or engaging our services.

01 Acceptance of Terms
By accessing or using the Peak Marketing website (peakmarketing.in) or engaging any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services.
These terms apply to all visitors, prospects, and clients of Peak Marketing, including free consultations and paid engagements.
02 Description of Services
Peak Marketing is a digital marketing, website development, and e-commerce management agency based in Patna, Bihar, India. Our core service categories include:
- Digital marketing & SEO — including advanced SEO, local SEO, Google Ads, Meta Ads, performance digital marketing, and content creation.
- E-commerce marketplace account management — Amazon account management, Flipkart account management, Meesho account management, multi-platform e-commerce, and Shopify store management.
- Reputation management — fake review removal, seller rating recovery, e-commerce reviews audit, and reputation management.
- Web development — custom website development and conversion-focused landing pages.
- Social & influencer marketing — social media management, influencer marketing, and content production.
This page provides a general overview only. The specific scope, deliverables, timelines, and pricing for each engagement are defined in a separate written service agreement or proposal that supersedes any general description on this website. In the event of any conflict between these terms and a signed service agreement, the signed agreement governs for the services it covers.
03 Client Responsibilities
To allow us to deliver services effectively, the client agrees to:
- Provide accurate, complete, and current business information when requested.
- Grant timely access and credentials where required — for example, marketplace seller accounts (Amazon, Flipkart, Meesho), advertising accounts (Google Ads, Meta Ads Manager), and website or analytics platforms.
- Provide timely approvals, feedback, and assets (such as brand guidelines, product details, or creative inputs) so that planned work is not delayed.
- Authorise and fund all advertising budgets and platform fees directly. Peak Marketing manages campaigns on the client's behalf but does not pay third-party ad spend on the client's account unless explicitly agreed in writing.
Delays in providing the above may affect timelines and results, and Peak Marketing is not liable for outcomes affected by such delays.
04 Account Access & Confidentiality
Because our services often require access to client marketplace, advertising, or website accounts, we handle your credentials and data with care:
- Access is limited to the team members directly assigned to your engagement.
- We use your account access only to perform the agreed services — we will not make unauthorised changes, share credentials, or use your accounts for any purpose outside the engagement.
- Client business data — sales figures, customer information, ad performance, strategy, and other confidential information — is kept confidential and is not disclosed to third parties except as required by law or as necessary to deliver the services (for example, to a platform we integrate with on your behalf).
- Access is reviewed and revoked when an engagement ends or a team member leaves the project.
The client likewise agrees to keep confidential any proprietary strategies, campaign frameworks, creative concepts, processes, and materials shared by Peak Marketing, and not to copy, resale, or redistribute them to third parties.
05 Payments, Pricing & Refunds
Our standard package pricing is published on our pricing page. However, the actual price, payment schedule, and billing terms for your engagement are set out in your signed service agreement or proposal and may differ from the published packages based on scope.
General payment and refund principles:
- The free consultation carries no charge and no obligation.
- Paid packages and retainers are billed per the schedule in your service agreement, typically in advance of each billing cycle.
- Because marketing services involve committed labour and ad spend already incurred, refunds are not automatically guaranteed. Requests for cancellation or refund are evaluated case-by-case in line with the signed service agreement and the work already performed.
- Where a refund is approved, it is typically limited to fees paid for work not yet started, less any third-party costs already committed on the client's behalf.
06 Intellectual Property
All content, strategies, campaign frameworks, creative assets, designs, copy, code, and other materials produced by Peak Marketing remain our exclusive intellectual property until full payment for the engagement has been received.
Upon receipt of full payment, ownership and usage rights transfer to the client to the extent and on the terms specified in the signed service agreement. Until that point, the client receives a limited, non-transferable right to use the materials solely for the purpose of the engagement.
Pre-existing tools, templates, methodologies, and proprietary processes developed by Peak Marketing remain our property even after a project concludes.
07 No Guaranteed Results
Digital marketing, SEO, and paid advertising are influenced by many factors outside our control, including platform algorithm changes, market conditions, competitor activity, seasonality, and the quality and pricing of the client's own products or services.
Accordingly, Peak Marketing does not guarantee specific search rankings, traffic figures, sales volumes, lead counts, or ad performance numbers. We commit to applying professional skill, data-driven strategy, and best practices — not to particular outcomes. Any performance figures shared in proposals are estimates or past examples, not promises of future results.
08 Third-Party Platforms
Our services rely on and operate within the policies of third-party platforms such as Google, Meta (Facebook/Instagram), Amazon, Flipkart, Meesho, Shopify, and others. These platforms set their own rules, algorithms, pricing, and account policies, which can change at any time.
Peak Marketing is not responsible for third-party platform policy changes, account suspensions or holds, listing takedowns, algorithm updates, feature deprecations, or fee changes imposed by these platforms. Where such events occur, we will assist the client in good faith to resolve them, but we cannot be held liable for outcomes determined by the platform.
09 Limitation of Liability
To the maximum extent permitted by law, Peak Marketing's total liability arising out of or related to an engagement is limited to the fees actually paid by the client to Peak Marketing for the services giving rise to the claim during the preceding three (3) months.
In no event shall Peak Marketing be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of revenue, loss of data, or loss of business opportunity, whether based on contract, tort, or any other legal theory.
10 Termination
Either party may terminate an engagement by providing written notice in accordance with the notice period set out in the signed service agreement. If the agreement is silent, thirty (30) days' written notice applies.
Upon termination:
- Any fees for work completed up to the termination date become payable.
- We will deliver completed in-progress work where reasonably possible, and provide a handover of agreed deliverables.
- Access to client accounts will be promptly returned and revoked, and the client resumes full direct control of their marketplace, advertising, and website accounts.
- Obligations that by their nature should survive — including confidentiality, intellectual property, and limitation of liability — continue after termination.
11 Governing Law & Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of India. The courts located in Patna, Bihar, India shall have exclusive jurisdiction over any disputes arising out of or relating to these terms or our services.
12 Changes to These Terms
Peak Marketing may update or revise these Terms and Conditions from time to time. When we do, we will revise the "Last Updated" date shown at the top of this page. Continued use of the website or services after changes take effect constitutes acceptance of the updated terms.
